So incredibly disappointing.

A San Francisco federal appeals court has overturned Judge Virginia A. Phillips' injunction against 'Don't Ask, Don't Tell,' and has ruled that the military must keep the policy in place.

According to the 9th Circuit:

"a stay pending appeal would obviate the confusion and uncertainty that might be caused by temporary implementation of the district court's injunction, with the looming possibility that the statutory policy could be reinstated on appeal. Enjoining the operation of the statute before the appeal is concluded would create tremendous uncertainty about the status of servicemembers who may reveal their sexual orientation in reliance on the district court's decision and injunction."

They may have won the battle, but they have not won the war!

It's only a matter of time, people!

This is truly amazing! A day to be remembered and celebrated!

Because of the injunction currently banning the 'Don't Ask, Don't Tell' policy, Lt. Dan Choi - who has fought tirelessly for gay rights in the military ever since he was kicked out over his sexuality - was able to re-enlist in the army yesterday as an openly gay man!

Although he originally intended to join the marines, he unfortunately found out he couldn't - but only because he was too old!

We're so thrilled to hear the news, and are so proud of Choi for being unrelenting in his fight for equal rights!

A well-deserved triumph, bb!

Yuck.

The Justice Department is set to file an appeal this afternoon to fight Federal Judge Virginia A. Phillip's injunction against the 'Don't Ask, Don't Tell' policy.

Although we expected that this might happen, we can't begin to articulate how disappointed we are with the Obama administration right now.

It's HAPPENING!

U.S. District Judge Virginia A. Phillips has just ordered the Defense Department "immediately to suspend and discontinue any investigation, or discharge, separation, or other proceedings" relating to 'Don't Ask, Don't Tell!'

Lawyers for the Justice Department are sure to appeal the injunction, but this is MASSIVE step in the right direction!
