As we previously mentioned, PETA is trying to sue SeaWorld under the 13th Amendment which prohibits slavery.
They argue that the 13th Amendment covers creatures of all species, and that SeaWorld rips orcas out of their homes and away from their families to be forced to perform.
The lawsuit was brought against SeaWorld by PETA, former trainer Ric O'Barry, some other experts and now Phil Hirschkop.
Hirschkop won an unprecedented case, Loving v. Virginia, which made interracial marriage legal.
"Forty years ago I fought for the fundamental right of people to marry the person of their choosing, regardless of race.
Now I'm fighting for these orcas' fundamental rights to be free from enslavement regardless of their species."
He has joined on to file a brief opposing SeaWorld's motion to dismiss the case.
We'll be interested to see if this goes to court and then what a judge would actually have to say about all of this.
