Jimmy Kimmel has successfully beaten a lawsuit against a video he made (above) in 2010 poking fun at LeBron James‘ decision to consult a rabbi over his “decision” to leave the Cleveland Cavaliers for the Miami Heat.
Rabbi Dovid Sondik, a small YouTube celeb known as the “Flying Rabbi”, sued after Kimmel used his online footage to portray him as the man James met with, Rabbi Yishayahu Yosef Pinto.
Sondik claimed that the silly video made him “look foolish” and a “laughingstock” after falsely portraying his voice, picture, and likeness as the voice, picture and likeness of Rabbi Pinto.
This isn’t a very happy Hanukkah for Sondik though because the judge tossed the case on the grounds of Free Speech. He also ruled that his character was not defamed because the video made by Kimmel wasn’t “mean-spirited or intended to injure such that its use would be excluded from First Amendment protection.”
The plaintiff’s attorney has said they plan to appeal the decision.
