Judge Denies Josh Duggar’s Motion To Dismiss Danica Dillon Battery Lawsuit

The hits keep on coming for Josh Duggar.

Earlier this week, the 19 Kids and Counting star’s motion to dismiss the lawsuit filed against him for battery by Danica Dillon, AKA Ashley Stamm-Northup, was denied by a judge. Yikes!

The judge J. Kearney ruled:

“We decline to grant Duggar’s motion to dismiss at this early stage of litigation where Stamm-Northup alleges Duggar treated her roughly, caused physical injuries, and she felt ‘as if she was being raped.'”

Initially, Duggar filed the motion back in December as his team defended that the porn star did not provide hard evidence of the alleged assault or battery.

The document argued:

“[Dillon] did not provide anything more than a formulaic recitation of the elements of assault and/or battery. Her labels and conclusions are not adequate, particularly because she states that she consented to physical and sexual contact in exchange for payment.”

That still doesn’t necessarily paint the father-of-four in the best light. Anywho, Josh will have to address the allegation by January 20.

We wonder if J Dugg will do that himself in person or let his lawyer handle this mess? Regardless, the TLC celeb is still in rehab following his Ashley Madison and molestation scandals that broke in 2015.

We have a feeling Danica may get the $500,000 she is asking for after this recent update. We guess we’ll just have to wait and see!
