Richard Henry Patterson is accused of murdering his girlfriend. But according to his rather unique defense, this was just a horrible sexual accident.
The 65-year-old Florida resident says his girlfriend, 60-year-old Francisca Marquinez, choked to death while performing oral on him.
According to a motion filed by Patterson last week, Marquinez “accidentally sexually asphyxiated during oral sex.” Patterson’s legal team even says the medical examiner will testify the cause of death is consistent with their story.
Now the accused is asking the court to allow him to show his penis to the jury so they’ll get an idea exactly what kind of penis could have caused such a tragedy.
Attorney Ken Padowitz says of the unusual request:
“The view by the jury is essential for them to fully understand Dr. Wright’s testimony and the defense in this case.”
The defense says the prosecution’s only reason for calling this a homicide at all is the fact Patterson told a friend that he choked Marquinez, which they took as a confession. Padowitz clarifies:
“He said he choked her. He never said he strangled her.”
So is this fatal fellatio even possible??
Renowned medical examiner Dr. Michael Baden told the New York Post:
“There’s quite a number of ways that sexual activity can lead to inadvertent deaths, but I’ve never heard of choking on a penis.”
BUT that doesn’t mean it didn’t happen. Baden explains:
“I’ve not seen it, that the penis alone will choke somebody to death. However, if there’s obstruction, it’s possible. And in order to choke to death, the penis has to obstruct the windpipe, probably down to the area of thyroid cartilage, or the Adam’s apple, for a period of time. One could have no air coming in for a period of time under these circumstances and that would be possible, but I have not seen it. But it is possible.”
Wow. We guess it makes sense it would be possible, especially without a gag reflex to protect you, which as we all know, some people don’t have.
We absolutely do not want to make light of this tragic situation, but we’d be remiss if we didn’t say it: remember to practice safe sex, everyone!
