CBS Sued Years Later For Airing Old Theme Song

CBS is getting sued over a music clip they first aired back in the ‘80s.
In an episode of Family Ties which aired in March of 1985, the main character takes a trip back to his childhood where a classic song is played. The song happens to the be theme song to the 1940s variety show, Texaco Star Theatre, which featured Milton Berle.
Originally the agreement allowed them to use the song in their show, but didn’t include any rights for them when the sitcom hit video and DVD sales.
So now years later, Kling Corp is suing CBS. A bit late there aren’t we?
Turns out Kling had originally demanded $19,000 for their licensing fee but will now be going after statutory damages for willful infringement. And each infringement can mean a $150,000 fine.
Though due to statute of limitations, if Kling wins, they’ll only be able to collect from the past three years of DVD sales.
We’ll have to wait and see how much money Kling will receive.
