The custody battle between Bethenny Frankel and Jason Hoppy is still raging five years later — and may have just hit its lowest point.
And that includes Jason’s stalking charges!
After the death of Bethenny’s on-off boyfriend Dennis Shields, you’d think her ex would give her a break.

Instead he’s using the tragedy!
In a hearing Thursday Page Six reports his lawyer, Robert Wallack, used the incident to malign the RHONY star’s parenting abilities, saying of Shields’ death:
“It was reported that he died of an Oxycodone overdose. Our concern is while his death is very sad this raises serious concerns about Ms. Frankel’s parental judgment.”
Wow. He continued:
“Dennis Shields spent a great deal of time with Bryn and even cared for Bryn at times when Ms. Frankel wasn’t around. Considering Mr. Shields’ addiction what does that say about Ms. Frankel’s parenting that she would allow this person to care for her daughter? This doesn’t just constitute a lapse in judgment this was just downright dangerous parenting”
According to reports, Bethenny was crying in the courtroom.
Wallack then went a step further, juxtaposing Shields’ reported overdose with an episode of Real Housewives, implying Bethenny had a substance problem too!
“There was a recent episode in which she appeared to be intoxicated. She was running around without clothes on and then she passed out and it was said she passed out from mixing Ambien with alcohol. Our concerns are whether Ms. Frankel may have some type of substance abuse problems so we would ask the court to order drug testing of Ms. Frankel to find out whether that’s an issue.”
This was a bit much even for the judge, who reportedly responded:
“Now you’re throwing grenades across the table.”
This may have officially become the most brutal custody fight we’ve seen.
