You know that jury had to be desperate to get outta this one!
Cuz finally, after so much mess, an appeals court has determined that Nicollette Sheridan was not wrongfully fired from Desperate Housewives.
As we’re sure you remember, Nicci also claimed she had been hit by show-creator Marc Cherry after a heated run-in over script dialogue.
Those charges were since dropped… but as far as the termination taboo goes, the judge says:
“Having reviewed the parties’ pleadings and heard oral argument, we conclude that the trial court erred in denying Touchstone’s motion for a directed verdict. A cause of action for wrongful termination in violation of public policy does not lie if an employer decides simply not to exercise an option to renew a contract. In that instance, there is no termination of employment but, instead, an expiration of a fixed-term contract.”
The court did say she could now sue again with the argument that the only reason she was fired was due to her complaints over Cherry’s behavior.
But an ABC lawyer says:
“Her last remaining claim for wrongful termination is gone, and while she may seek to add an OSHA claim, we believe we will prevail on that claim as well.”
Might be time to pack up the legal fees and find a new beginning, huh Nic??
