Sears Settles Suit For $6.2 Mill

On Tuesday, Sears Holding Company agreed to shell out $6.2 million to settle a class-action lawsuit filed by the EEOC (the equal employment peeps) for alleged disability bias.
In the suit, the EEOC claimed Sears failed to provide the required accomodations for employees returning from workers comp leave and remained disabled, as mandated by the Americans with Disabilities Act.
The win for the EEOC was the largest $ettlement for a lawsuit under the Disabilites Act.
In addition to the $$$, Sears must adjust their workers’ compensation leave policies.
However, Sears belives “that it reasonably accommodates its assocaites on leave due to work-related illnesses or injuries under the Americans with Disabilities Act.”
According to the judge, you don’t!
