Former members of Sublime Bud Gaugh and Eric Wilson were faced with a preliminary injunction in a California court on Tuesday, which forbids them from performing or recording under their original band name.
The estate of the band’s late frontman, Bradley Nowell, are legally pushing to uphold his wishes for Sublime to never continue without him.
So, when Bud and Eric were billed last month as Sublime, eyebrows were raised and injunctions were upheld – at least until the breach-of-contract/trademark infringement suit goes to trial or a settlement is reached.
The representative for the Nowell estate, Jeremiah Reynolds, states:
“The point we tried to make is that we encourage these gentlemen to go out and play. We think they├óΓé¼Γäóre great musicians. We just don├óΓé¼Γäót think it├óΓé¼Γäós appropriate to call a group that doesn├óΓé¼Γäót have Bradley and has a new lead singer Sublime. It├óΓé¼Γäós consistent with Brad├óΓé¼Γäós intentions that we seek to protect the name. The court agreed that Bud and Eric and the new lead singer didn├óΓé¼Γäót have the right to go out and call themselves Sublime.”
Gaugh and Wilson continue to fight for the right to perform as Sublime and spread the band’s “message of hope and love” and $$$$$!
