Tracy Morgan may be on the road to recovery, but the driver who caused the six-car pileup is on a one-way street to prison- and he’s trying to hit the brakes.
Kevin Roper has plead “not guilty” to vehicular homicide and assault by auto.
The Walmart truck driver was arraigned on Wednesday at the Middlesex County Superior Court in New Brunswick, New Jersey.
The court argues that the fatal accident, which injured Tracy and killed comedian James McNair, was caused by Roper’s unfit mental state after being up for more than 24 hours straight.
Roper could face up to 15 years in prison if convicted. No court date has yet been named. Roper is currently out on $50,000 bail.
