Is Trey Songz STILL Battling With A Storage Wars Star Over A Catchphrase?

Does anyone else think that this legal battle is pretty silly?
Trey Songz has been battling with Storage Wars star David Hester since last fall over the use of the catchphrase, “YUUUP!”
Hester says he trademarked his signature expression three times last May, but Songz filed paperz in New York court on April 2 that claim he’s had it trademarked since 2009.
Now the R&B star has counter-sued the reality star for the exclusive rights to say, “YUUUP!” He wants the judge to void his competition’s trademark and award him damages.
We have a question though. If Mr. Songz really did have the phrase trademarked in 2009, then how would Mr. Hester be allowed to trademark it in 2011? It sounds like the United States Patent and Trademark Office needs to get their shiz together to avoid any more legal altercations like this in the future.
Also, would it really be that hard for one of these guyz to come up with a NEW catchphrase? Apparently, “UH-HUHHH!” (we’ll let one of them have that for free)
