A judge in Boston made two important rulings today concerning same-sex marriage. Two cases were brought to his attention concerning Section 3 of DOMA, the Defense of Marriage Act.
This particular section of the act limits the definition of marriage to apply only to heterosexual couples and excludes homosexual ones from federal benefits. After hearing both sides ruthlessly argue, the judge deemed the act “unconstitutional.” In both cases, the judge ruled that DOMA failed to “meet even the most simple judicial review, rational basis — in other words, there was no justifiable reason to the federal government to treat same-sex couples.”
Bravo! Well said!
Of course, that isn’t the end of either case. Now, they will be taken to the U.S. Court of Appeals, where not only will each case be reviewed, but also argued whether their is a “legitimate need” for DOMA in the state!
