If at first you don’t succeed, try, try again.
Diddy is once again asking the judge to declare a mistrial in his jaw-dropping case. And this time around, he is hoping that the judge will see it his way regarding what his lawyers claim is an issue with the prosecutors presenting testimony they knew (or should have known) was false!
According to a report in TMZ on Saturday evening, Diddy’s lawyers filed a letter with the court early on Saturday morning asking yet again for a mistrial. This time around, his attorneys claim that testimony related to the alleged incident involving Diddy ex Cassie Ventura‘s friend and fashion designer Bryana Bongolan is totally phony.

As you may recall, during the trial, testimony came up that Diddy allegedly held Bongolan over a balcony railing 17 stories in the air. Which, um, TERRIFYING!! But the issue according to the music mogul’s lawyers is that the testimony presented about the incident is untrue because Cassie didn’t see it herself.
So, on the stand, Cassie testified about the incident by claiming that she saw Diddy holding Bryana over the edge of the balcony. But that’s crap, Diddy’s lawyers claim, because they pointed the court towards texts between Cassie and Kristina Khorram — Diddy’s close employee whom he often called his chief of staff — which indicated Cassie didn’t see the alleged incident at all! The key text message read:
“I just found out some crazy s**t.”
Found out, and not saw. Note the difference?! That is, because Diddy’s lawyers say Cassie didn’t actually see the alleged incident firsthand, but rather only supposedly heard about it after the fact, they basically say her testimony on the stand is no bueno since it’s hearsay and not personal experience.
There are other issues, too. Namely, Bryana herself testified that Diddy allegedly held her over the edge of the balcony only to pull her back from it and allegedly throw her into some furniture. In turn, that caused injuries on her leg and neck. Prosecutors even showed those injuries in court via photos taken from the time!
But the metadata on the photos indicates they were taken on September 26, 2016. And Diddy’s attorneys are now arguing that he couldn’t have been anywhere near Bongolan on that date. They even presented evidence that the mogul was on the east coast at the time and could not have thus been involved in what he’s accused of doing on that timeline.

In response, prosecutors have since clarified that Cassie’s text messaging reveal (the same exchange referenced above) would seem to claim the incident actually occurred a few days later than that, on September 29 or 30. A point in which Diddy apparently was in town. So, everybody is moving in a flurry on all this stuff.
We’ll see if anything comes of this mistrial request the second time around. The judge could drop a decision on it at anytime. Guess we’ll see if Diddy gets his way this time, or if yet another mistrial motion fails to materialize!
