Someone surprising doesn’t feel Lyle and Erik Menendez should be in prison for the rest of their lives… No, not Netflix viewers. The LA County District Attorney! And a newly-uncovered letter may be key in helping them get out.

The infamous brothers are back on everyone’s minds right now in the wake of Ryan Murphy’s Monsters: The Lyle and Erik Menendez Story. The real-life brothers killed their parents Jose and Kitty Menendez on August 20, 1989. After years of litigation, their 1996 trial concluded with first-degree murder convictions and life sentences without the possibility of parole. But Los Angeles DA George Gascón feels they don’t “deserve to be in prison until they die” as a revealing piece of new evidence has come to light.

On Sunday, Gascón released on social media a screenshot of a letter Erik allegedly wrote to his since-passed cousin Andy Cano detailing his father’s infliction of sexual abuse in 1988 — a year before he and Lyle killed their parents. The letter reads:

“I’ve been trying to avoid dad. It’s still happening Andy but it’s worse for me now. I never know when it’s going to happen and it’s driving me crazy. Every night I stay up thinking he might come in.”

This letter, which was uncovered in 2023, was not introduced as evidence in their 1993 OR 1996 trial. And it’s good evidence. It’s what’s known as contemporaneous evidence, proof Erik was making the accusation about his father at the time, not something he came up with later. You see, during the brothers’ first trial in 1993, the prosecutor accused them of fabricating their allegations of sexual abuse to avoid murder convictions. This proves they didn’t just lie about it for the trial.

The Menendez brothers’ legal team filed a habeas corpus petition with the LA County Superior Court to introduce the new evidence into their case — and DA Gascón agrees with them! He feels that if it would have been a huge factor in their ’90s trial. He said during a press conference earlier this month:

“If there was evidence that was not presented to the court at that time, and had that evidence been presented, perhaps a jury would have come to a different conclusion.”

The DA announced earlier this month that he’s reviewing the “new evidence” to decide whether or not he will recommend to a judge that the brothers should be granted a resentencing. During a clip from a forthcoming episode of IMPACT x Nightline titled Menendez Brothers: Monsters or Victims? obtained by People, Gascón states:

“Given the totality of the circumstances, I don’t think they deserve to be in prison until they die.”

The brothers’ defense attorney Mark Geragos said in the same episode he hopes they will be released by Thanksgiving of this year, but a judge would still have to approve a resentencing even if Gascón does recommend it.
