A New York judge tossed Howard Stern‘s lawsuit against SiriusXM Radio out of court last week, but the shock jock isn’t backing down.
He has appealed the ruling and maintains the company screwed him out of “promised” stock awards after exceeding target subscribers.
Howard’s team felt they were owed $300 million, but the judge said his contract’s language ├óΓé¼┼ôis inconsistent with any reading that the parties intended subscribers acquired by merger with XM to be considered├óΓé¼┬¥ in awarding stock.
Lawyers for the infamous radio host countered with this argument:
“Reversal is warranted because, among other things, the parties’ contract is clear on its face that plaintiffs are entitled to the relief they seek or is, at a minimum, ambiguous.”
Can SiriusXM dodge this angry bullet twice? We shall see!
