Jack Avery is taking steps to protect himself as more shocking details about Gabbie Gonzalez‘s arrest drop!
As we previously reported, the influencer was arrested in California last week after allegedly conspiring to commit murder. Gabbie allegedly tried to hire a hitman to kill Jack, her baby daddy and former member of the boy band Why Don’t We, back in 2021 amid their custody dispute over 7-year-old daughter Lavender. And she allegedly wasn’t alone in orchestrating the murder-for-hire plot! Her dad, Francisco Gonzalez, was arrested on Monday in Florida for the same alleged crime, too!
Jack has not spoken out about the arrests yet. However, he raced over to the courthouse on Tuesday to file for a temporary restraining order against Gabbie, as well as sole legal and physical custody of their child instead!

According to TMZ, Jack claimed in the filing that the FBI told him Gabbie, Francisco, and her friend Kai Cordrey conspired to hire a hitman to kill him. And because of the alleged illegal scheme, the musician doesn’t want Gabbie near him or Lavender. He doesn’t even want her to have any visitation with the kid due to the criminal proceedings. And can you blame the man? That is, if the allegations against the Gonzalez family members are true!
Jack also said having sole custody rights would allow him to get Lavender a therapist to help her process this experience, which, you can imagine, has likely been traumatic for her. In the court documents, the singer said the child was staying with a foster family after Gabbie was arrested on Friday, and he flew to Northern California to get her. But when he arrived, he alleged he was told Lavender blamed him for her mom’s arrest. He claimed Gabbie has been bashing him in front of their daughter.
And since Gabbie’s arrest, her family allegedly hasn’t stopped reaching out to Jack to know where Lavender is. The performer claimed things escalated on Saturday when two of her friends came to his house and started banging on the front door, looking into his Ring camera, and saying they could “do this all day.” He now feels like he and Lavender aren’t safe in his home.
Additionally, Jack alleged that Gabbie traveled with Lavender around the world before her arrest and refused to let him know where they went. In fact, he allegedly didn’t even know they were in Northern California until the TikToker was arrested last week. He added that the FBI warned him it wasn’t safe for him to be around Gabbie, but he wanted to see his kid and “had to learn to manage my own fears and anxiety” during custody visits and exchanges.
What a wild situation! And there’s more! Shortly after news of the allegations broke, Gabbie’s estranged husband, Cody Clayburn, took to Instagram Stories to post to celebrate! Yes, really! He posted her mugshot along with the caption:
“Karma.”
And that’s not all! It turns out Cody was one of the key witnesses in the case!
According to court docs obtained by TMZ, Cody and McKenzie Ferry exposed the alleged murder-for-hire plot! A source with direct knowledge explained that McKenzie was a live-in nanny for Gabby, and she alerted the authorities about the scheme in 2021. For his part, Cody was “married” to the social media star, but not legally, after she had Lavender with Jack. The LA County Sheriff’s Department claimed he told police that Gabbie was in a nasty custody battle, and Francisco got heavily involved in the dispute. Cody claimed to the cops that the pair were “obsessed” with getting full custody of Lavender, and Francisco once said it would have been cheaper if Jack were dead.
After Gabbie and Cody got married in 2022, TMZ reports the FBI raided their home in Hawaii, confiscated electronics, and interviewed Gabbie. Sources say McKenize’s report triggered the raid, and that Jack had been notified about the alleged plot by then. However, insiders claim the feds felt they didn’t have enough evidence and handed the case over to the LA County Sheriff’s Department last year. Then they reinterviewed witnesses and determined they finally had enough for the arrests. Police allegedly planned to arrest Gabbie in June during a child custody exchange, but she stopped communicating with Jack, so they moved the timeline up.
