Jackie Evancho's Transgender Sister Wins Big In Bathroom Rights Case!

jackie evancho sis wins transgender bathroom case
This is HUGE for not just Jackie Evancho‘s sister, but for the entire Transgender Rights movement!
On Monday, a Pennsylvania federal judge ruled that Juliet Evancho, along with fellow plaintiffs Elissa Ridenour and A.S., must be given access to the bathrooms at their school which match their gender identity. Of course, this is such a big win for the transgender community as Donald Trump recently rescinded federal protections for transgender students which allowed them to use the restrooms and/or changing rooms that matched their identified gender.

Nonetheless, US District Court Judge Mark R. Hornak is on the right side of history as he issued a temporary injunction which bars the Pine-Richland School District from forcing Juliet and her peers into using private bathrooms or restrooms matching their birth sex.
In regards to his ruling, Hornak wrote:

“The Plaintiffs appear to the Court to be young people seeking to do what young people try to do every day-go to school, obtain an education, and interact as equals with their peers. ├óΓé¼┬ª [T]he Plaintiffs have shown a reasonable likelihood of success on the merits of their claim that the District’s enforcement of Resolution 2 as to their use of common school restrooms does not afford them equal protection of the law as guaranteed to them by the Fourteenth Amendment.”

While the judge believes the threesome will likely prove the school district denied the kiddos their equal protection rights — which is supposed to be guaranteed under the 14th Amendment of the U.S. Constitution — he danced around commenting on the notion that a Title IX violation had been made.
In case you forgot, under the Obama administration, it was accepted that Title IX of the Education Amendments of 1972 protected transgender students’ rights to use facilities which coordinated with whatever gender they identified with.
However, Drumpf sparked national debate when he revoked these guidelines. Ugh.
Regardless, the students and their attorneys are celebrating this win. Lambda Legal Staff Attorney Omar Gonzalez-Pagan noted in a statement:

“Such policies are not only wrong, they are illegal. The rescission of a guidance by the Trump administration cannot change that.”

Hear! Hear!
We wonder if Trump will comment on this court ruling, especially since Juliet’s sis sang for POTUS at his Inauguration. We guess we’ll just have to wait and see…
