UPDATE 10/7/24 5:30 P.M. PST: Jax has refiled! After the drama of his previous filing, which went through with a number of OOPS! and without legal counsel, his new filing clarifies a couple things. For one, yes, they absolutely were legally married… and yes, they separated on January 24. Second, he is still willing to give Brit primary custody of their son, so long as he still gets to see Cruz every Wednesday and every other weekend.

In a surprising move, Jax Taylor has given Brittany Cartwright full physical and legal custody of their son Cruz!
According to Page Six on Tuesday, the Vanderpump Rules alum represented himself when signing his rights over to his ex in court documents he filed last month. Along with giving up custody, the reality star said their only asset is their Los Angeles home, which he requested to divide “at a later time.” Whoa. He’s really being so chill and non-confrontational about all this! So rare!

But there’s something odd, too. While requesting a dissolution of their marriage, he also claimed they were never legally married!
Wait, WHAT??
Us Weekly also obtained a copy of the filing, which was submitted on September 26 — and he cited that day as their date of separation (MONTHS after when his ex-wife says the marriage ended, btw). More concerning? He checked two important but contradictory boxes! One stated they were married, and another stated, “respondent contends that the parties never legally married or registered in a domestic partnership.” What the heck, dude? How can both those be true? LOLz!
On Wednesday morning, The Valley star’s rep told the outlet that he “made errors” on the paperwork — which he filed without the help of a lawyer. Uh oh! Is this gonna be a problem?? The rep doesn’t think so, explaining:
“While Jax made errors in filling out forms that are usually done by trained legal professionals, those errors will be amended without delay.”
While the rep didn’t say it outright in the statement, Us Weekly claims the error was made in checking the “never legally married” box. What a crazy thing to get wrong amid a literal divorce. Hah! But the mention of “errors” plural has us wondering if there were even more issues, too! We wouldn’t put it past him.
The good news is the rep also confirmed child custody was not an issue in the split. They continued in the statement:
“Jax and Brittany have already long resolved all matters related to custody of Cruz, and will continue to work together privately for the best interest of their son, which remains their overriding concern.”
Well, that’s nice! It’s refreshing to see them put the 3-year-old first!
As Perezcious readers know, the Bravo personalities started dating in 2015 before tying the knot in 2019. They welcomed their child in 2021, but hit a rough patch at the start of this year. After taking some time apart, Britt filed for divorce on August 27. She cited their official date of separation as January 24, 2024. Amid the split, Jax checked himself in for mental health treatment, leading to a bipolar disorder and PTSD diagnosis as well as the realization he’s a narcissist.
While things have certainly been rocky, Brittany has remained hopeful about the state of co-parenting — maybe ’cause she knows it’s all working out in her favor. On Tuesday, she told E! News:
“We’re okay, we’re co-parenting. That’s the most important thing. Other than that, it is what it is.”
She added:
“It’s going to be fine no matter what, because we both love him so much. […] So, even if Jax and I are fighting, it’s not going to ever come between Cruz.”
Good!
It’s gotta help that she won custody without much of a legal fight! Now, let’s just hope Jax can get his paperwork sorted out (and maybe employ the help of a lawyer) to get the rest of the split settled quickly!
