This is unexpected family drama…
As you may recall, Malcolm-Jamal Warner tragically died on July 20, 2025, after drowning in the ocean while on a trip in Costa Rica with his wife and his 8-year-old daughter. And exactly one year after his death, the 54-year-old actor’s widow is suing his mother, Pamela Warner, because he failed to honor their prenuptial agreement. The mom is the trustee of the Warner Family Trust, which the Grammy winner reportedly set up in 1996.

According to a lawsuit obtained by TMZ on Tuesday, Tenisha Warner claimed Malcolm promised to give her several financial benefits as part of a prenup they signed in May 2022 — days before they got married. However, the Cosby Show alum allegedly failed to keep up his end of the bargain before his death.
The lawsuit claimed Malcolm agreed to maintain a $1 million life insurance policy and name Tenisha as the sole beneficiary, but he never purchased or maintained one. His wife further alleged that he didn’t make annual tax-free payments of $16,000, fund a Roth IRA for her, or pay her a $5,000 monthly salary for serving as his chief of staff and assistant during their marriage. Because of all that, she believes she is entitled to at least $1,276,042.46 — including $1 million for the life insurance policy, more than $50,000 in anniversary payments, $30,500 for the IRA, and $195,000 in unpaid salary.

Tenisha alleged Malcolm’s estate doesn’t have enough assets to cover the debt, so she asked the court to let her recover the money from his family trust. Additionally, she is demanding interest, attorney’s fees, and an order barring Pamela from giving away any money or property from the trust during the case.
Pamela hasn’t addressed the allegations yet. However, she did post a lengthy, emotional tribute to Malcolm on the first anniversary of his death — and the day Tenisha filed the lawsuit. She expressed on Instagram that it’s “amazing how a year of pain, hurt, loss, emotional destabilizaton, and most importantly growth, has come and sits here before me,” adding:
“During my year long journey, I have discovered how cruel, evil and greedy a human can be. I have also discovered the depth of love, care, concern and support that humans are capable of. All of which I have been the recipient of. The good, the bad and the ugly. These are the lessons that apparently I will need as I continue my journey. … Please take care of yourselves and those who you love. Let them know that they are loved. Clear up any beef you may have with your loved ones, if possible. Cleanse your spirt of negativity. We all have an expiration date. Don’t leave or let your loved one leave without them knowing that they are loved and treasured. That knowledge and ‘clean plate’ has helped me to survive.”
