Well, this is a major legal victory for Will Smith!
After months of ugly allegations and a lawsuit that grabbed headlines for all the wrong reasons, a judge has officially tossed out the sexual harassment case brought against the actor by violinist Brian King Joseph. And while the legal drama may not be completely over yet, this is undoubtedly a very big win for the Oscar winner.

As we previously reported, Brian — who toured with Will last year — filed a lawsuit accusing the movie star of sexual harassment and wrongful termination tied to an alleged incident that supposedly took place in Las Vegas in 2025. The claims were eyebrow-raising from the very beginning and included accusations that someone entered Brian’s hotel room while he was away and left behind some very strange items.
According to the lawsuit, the violinist allegedly returned to his room to discover wipes, beer, HIV medication, and a handwritten note that read:
“Brian, I’ll be back … just us.”
The note was allegedly signed “Stone F.”
Brian claimed the situation left him feeling disturbed and convinced that he was being “groomed” for a sexual encounter. He also alleged that after he reported the incident, he was fired from the tour.
But Will’s legal team pushed back hard against the claims and asked the court to dismiss the lawsuit entirely. And now, this week, the judge has sided with them!
In the ruling obtained first by TMZ on Thursday, a judge concluded that the allegations in the complaint simply did not meet the legal threshold required for a sexual harassment case. Specifically, the court said that the lawsuit:
“…fails to adequately allege conduct that is sufficiently severe or pervasive.”
Oof!
The judge also pointed out one other major issue with Brian’s complaint: apparently, the court was not convinced there were enough facts tying Will directly to the alleged hotel room incident. In fact, the ruling noted that Brian had left his bag — which contained his room key — in a van with other crew members before getting it back hours later. That detail seriously weakened the argument that only Will or his management team could have accessed the room.

So for now, the lawsuit has officially been thrown out.
However!!! Before Team Will starts celebrating too hard, there is one important catch: the judge did give Brian the opportunity to amend the complaint and refile it with stronger allegations if he chooses to do so. So, technically, this legal battle may not be completely finished just yet.
Still, there is no denying this is a huge development in the Independence Day star’s favor.
