Sucks!
Some of New York's glitziest restaurants have been accused in recent lawsuits of stealing tips and cheating wait staff out of wages.
The establishments named in the suits include Nobu, Pastis, and Jean George.
Robert DeNiro's Nobu is getting lots of bad press these days!
An attorney representing several restaurants, tried to lay blame on 'decades-old workplace labor laws, as well as state and federal laws that do not clearly state who can share in tips and how they should be divided'.
The legal bloodhound went on to say, "It is a result of these antiquated laws and regulations that plaintiff class action lawyers have been able to swoop in and take advantage."
So legal greed is driving fair labor practices at NYC restaurants?
We say tip your NYC waiter in cash and hand it over to them directly!

that's something i'm not used to out here in california. back in ohio the waitresses were paid like $2/hr and they got their tips and out here, they get minimum wage and tips. i wish i could be a waitress….

It's a scam, it's a way of the restaurant taking a kick-back for letting the waiters work there. It is supposed to be illegal and in most states it is. NYC is just behind the times in clamping down on them for doing it.

from what i understand out here in CT… it doesnt matter if the tip is in cash or on a credit card. each persons tips still get pooled and then distributed among the waiters, hostest, bus boys and maybe another person or two. its called tipping out. and the only thing that matters when it comes to cash or credit card tips is that cash tips wont be taxed because they arent part of the pay check.
I think they probably have to contribute to a pool for bartenders and busboy/busgirls — so even if you hand them cash, it still doesn't all go to them.

I have never worked as a waitress, but…I have a few friends who put themselves through school, and supported their families by doing so. Waitresses, bus boys/girls, hosts/hostesses and cooks bust their ass to provide a pleasant atmosphere and meal for their customers.
They are entitled to be compensated (by way of tips) for good/excellent service. I refuse to leave a restaurant without leaving a generous tip (in fact there was one time that I completely forgot to add one onto the credit card slip…and, I immediately went back to give her one). Hell, one time a new waitress spilled an entire glass of iced tea all over me. I STILL left her a tip, though….since she offered to pay my cleaning bill (which I told her was not necessary) and she was sincerely apologetic. Accidents happen.

I waitressed in California about 10 years ago - I was 3.10 an hour plus tips, then we had to tip out to the bartenders, busboy/girls and line cooks…… yeah it sucked
Re: FiveBIFive – I fully agree with you! The last I heard…waiters/waitresses make LESS than minimum wage. If they only get $2 per hour, and work for 8 hours…that would only bring in $16 per day. How many of you could live on that? Hell, it takes about $50 to fill up my gas tank…let alone all of my other bills.

I guess I just sympathize with him….my like 5 and 6 yr old half brother and sister were forced to do things to each and their babysitter, 15 yr old Amanda!!! can you believe that? a 15 yr old girl making kids do stuff to each other and herself!
plus I was basically raped by a dentist, who I thought was my friend (provided we were doing meth together and he brought me to his offce after hours) but anyways he gave me enough laughing gas to know me out cold and then when I came to he was telling me how much of a good fuck I was….

Re: -ohmy- – I can see your point, in that it sucks to share your tips. But, think about this…..you, as the waitress, pretty much just took the order, relayed it to the cooks and bartenders, delivered it and returned to the table a few more times for drink refills, dessert orders and to put the bill on the table.
The cooks prepared the meals (in a hot kitchen), the bartenders prepared the drinks and the bus boys/girls cleaned the dirty tables. You didn't even have to wash the dishes.
My point being…every employee in the restaurant has a right to a portion of the tip.

I was a server in New York and it sucked! The owners of my restaurant pooled all of our tips and then handed out the average the next day after tipping out everyone and themselves. I would make about $300.00 in tips and walk with $150.00. Shady and horrible.

here in texas waiters make $2.13 hr plus tips. if i worked all day from 10am til 11pm with a 1 or 2 hour break i will make about $200 in tips but after the "tip share" which goes to the bussers, host, silverware roller, bartender, and food runner, I only walk with around $140 if I'm lucky enough to get good tips all day. even if the tip is cash there is still a percentage of the sales that is automatically taken out before i even see it… no bueno!!!!
Re: Larry The Fairy – If you don't feel like sharing with the other employees, who just so happen enables you to do your job (well, YOU don't do the cooking or bartending, do you?)…then, I suggest that you find yourself another job. Perhaps one where YOU do all the work, cleanup, customer service, cooking, etc.

Wait folks get screwed by the IRS also. They have to pay on everybodyies tips. There is a set amount. So always give 15%. at least.
Hopefully a Dem Congress and President can change this outrage for hard working folks.

Re: Anonymous – You are stereotyping the job of s waiter. First of all, hosts and bussers get paid hourly, some way over minimum wage. Second of all, the cooks get paid a decent amount OR salary. As for the bartender, they do deserve some cut of the deal but they make their own tips too and might I add, much better tips than servers. Servers dont just "take the order and drop the food down" but they're also mediators, they have to put up with bitchy people, in a lot of cases they clean up the mess, vacuum/mop and perform a TON of other sidework tasks. I know this because I work my ASS off as a server with 12 hour shifts and shitty wages to work through college. So don't you dare say that we don't work and that other people do our job for us.
I have worked in three retaurants that "tip pool" and you have to turn in all cash tips too. You get a weekly paycheck with your tips.
