Despite already changing the label from reading "100% Blue Agave tequila" to simply "premium Blue Agave tequila," a New York couple is suing the company behind Bethenny Frankel's Skinnygirl Margartias for false advertisement.

Their argument against Beam Global concludes that the tequila included in the bottled margarita is "a lower quality and purity tequila by-product called mixto— essentially a mash of tequila and some unknown additives (rarely organic) which may comprise as much as 49% of the final mixed liquor."

As if offering further proof that the alcoholic beverage does not contain the stated premium tequila, their lawyer added, "100% blue agave is not stuff people mix."

That lawyer and lawsuit do recognize that the Beam team removed the "100%" part from the label, but still aren't happy with even the mention of Blue Agave because, according to them, the "entire marketing campaign, both its advertising and labeling, is based on falsehoods."

This legal action is an amended version of a $10 million class action lawsuit against the drink that started over false claims by the manufacturer that Skinnygirl margarita is "all natural" with "no preservatives."

Beam team calls Christopher Rapcinsky and Erin Baker's lawsuit "frivolous" and maintains their innocence, saying:

"Skinnygirl Margarita is made with premium blue agave tequila and meets the highest quality standards. We will defend our case vigorously, and we are fully confident we will prevail."

We're pretty confident they'll prevail too as long as Skinnygirl contains ANY amount of Blue Agave tequila. Do U think this lawsuit stands a chance in court?

After Skinnygirl Margarita was pulled from the shelves of Whole Foods, a grocery store known for it's healthy choices, Bethenny Frankel has had some explaining to do!

According to Whole Foods, they "had to stop selling" Bethenny's product because "it contains a preservative that does not meet our quality standards."

It turns out the preservative in question, called sodium benzoate, can become carcinogenice if mixed with other substances!

Although Bethenny let some words fly to the press, she has finally made a formal statement on her website, writing:

"There has been a lot of coverage in the media about my Skinnygirl Margarita cocktail.

We would not sell anything that I don’t personally drink. I’m a natural foods chef and health is a top priority for me and my family. The Skinnygirl Margarita is made with natural ingredients and its label is consistent with U.S. federal regulations, which is why it is carried in stores nationwide and continues to fly off the shelves.

I built my brand on trust and honesty. I don’t take lightly obvious attempts to put my integrity in question. I will always answer your questions and concerns directly and truthfully."

It sounds like she is confident the margarita will continue to sell despite the bad press and isn't making any apologies for any ingredients.

Bethenny Frankel's SkinnyGirl Margarita's Are Carcinogenic?!?

As we FIRST reported to our readers back in August, Whole Foods pulled Bethenny Frankel's SkinnyGirl cocktails from their shelves, but now we know why.

The healthy grocer released a statement that they "had to stop selling" Bethenny's product because "it contains a preservative that does not meet our quality standards."

Apparently, the "shelf-stable" margarita contains a preservative called sodium benzoate, which can become CARCINOGENIC if mixed with other substances such as vitamin C, such as mixing it with LIME, a very popular garnish for a margarita.

Bethenny, however, doesn't seem too worried that her product's removal from Whole Foods will affect her business, saying:

"With all due respect to Whole Foods, we were in a dozen of their stores and have decided not to continue in these stores. They represent an infinitesimal fraction of our business. We are, in fact, the fastest growing spirits brand in the US . . . We were bound to piss someone off, and everyone loves to try to tear down a success. This is a non-event."

In regards to anyone questioning SkinnyGirl Margarita because of health risks, the desperate housewife said:

"I'm not making wheatgrass here. If I could put an agave plant and some limes on a shelf I would. [The Skinnygirl Margarita] is as close to nature as possible, while still being a shelf-stable product."

Beam Global, the company that supplies the margarita, has said that the drink has "extremely low levels" of sodium benzoate and noted that it's a "very common" preservative.

What's in the unique margarita? The actor explains his cocktail contraption, saying:

"I have my own version of the margarita: tequila, lime juice, orange liqueur and tonic water, topped off with cranberry juice."

Mmm, that actually sounds pretty good! He likes to indulge in his alcoholic treat while making his special barbeque sauce, but unfortunately, he doesn't spill the ingredients for his secret sauce, as he continues to explain:

"I like to whip it up when I'm doing my special barbeque sauce for steak. It satisfies the taste buds in time for the meat. I love being in the kitchen and cooking generally - it fuels my soul man!"

A man who looks good with his shirt off and loves to cook? Sounds like his partner Camila Alves is one lucky lady!
