That poor little baby!
Madonna's attempt to adopt a motherless little girl, living in an orphonage in Malawi, was shot down by a local judge on Friday.
"The decision came down to residency requirement and the fact that the judge believes she was being well taken care of in the orphanage," said Zione Ntaba, a spokeswoman for the Malawi Justice Department. "For the Malawians, the fact that the child is at an orphanage, is being taken care of and is going through the school education system, that does qualify as the best interests of a child."
You see, that's the problem!!!! If "residency" was an issue this time around, then they shouldn't have made an "exception" for Madonna when she adopted little David from Malawai without having residency!
It was not clear why Judge Esme Chombo ruled differently Friday. Another judge had handled Madonna's previous adoption case.
Plus, a baby would be better suited in an orphanage instead of at a loving home with a mother and siblings - and LOTS of money????
If she's so inclined, Madonna can appeal today's ruling to Malawi's Supreme Court.

If they let her BUY another child, it was pointed out that it would open the door for anyone from around the world to do the same. Meaning, anyone could go there and within 2 or 3 days, leave with a child. Ever hear of child prostitutes? Child trafficking? Good! I help run an orphanage in Malawi and find the fact that she thinks she can go over there and buy a baby absolutely shocking. There are hundreds of orphanages in the country. Why not spread the wealth and support local families to take in children instead of funding one charity to "produce" orphans for her? Malawi is considered a poor Nation but the government still funds local most orphanages and if they are not government funded then they are funded by the local people. In the states and in most developing countries the government is rich whilst in developing countries its usually the other way round, they people are better off than the government cause the do businesses e.t.c which result in a huge class difference i.e very rich or very poor.
and in malawi ( i am Malawian) we believe in investing in our childern so they is nosuch thing as abondoned child like you guys have here ( lost in your systems) a childalways have either a distant relates, or peoplewho arent even related to them take care of them because thats just our culture. we havent lost touch with our humanity and the need to help one another, so even if those kids are living in a orphanage they are loved. people go visit these kids daily, primary education is free in malawi so they have access to free education. They may not have Madonna's millions but dont you dare say those kids are better off!! they is a reason Malawi is called the warm heart of Africa so back off with your negativity.

I can see both sides of the argument with this one. Anytime adoption takes a child away from their birth country I can see the problem. But then again, having a child adopted from an orphanage into a loving family ( wealthy or not) has to be better. But if this was their "law" she shouldn't have been allowed to adopt the first time……
We don't know all the details about how she went about adopting Mercy. They said she went there bullying by using her money and status. They also said they like for the potential adoptive parent to be a residence for 18-24 months. That's ridiculous! I didn't get that part, because she wasn't a residence when she adopted David. Besides, didn't she kinda form a "relationship" with Mercy a year or so ago? I don't think she just now decide to adopt her. Something is just not right here.

I'm not the biggest Madonna fan, and quite frankly having LOTS of money shouldn't be a big factor, but I agree that this little girl would be MUCH, MUCH better off w/ Madonna and her family. The fact that David is already with her and this little girl would have a sibling of the same nationality, should have eased the residency clause, not strengthened it. Public pressure.

I knew a family who did the same thing Madonna did. They adopted one African kid and just had to adopt another one 1 yr later because they fell in love with her. And when she came to the US, they had huge parties for the child inviting everyone from their prestigious firms and all the relatives and friends. But behind closed doors the mother complained about all the expenses, had the nanny take care of both kids 90% of the time, and complained about the little girl's behavior, even stating that she HATED the kid at times. This is all a trend. White people adopting ethnic children in order to call attention to themselves and stay in the limelight. Who are we to say that the child needs to grow up in La or NYC in a penthouse in order to be happy. Orphanages are terrible because it means the child has no parents. But it doesn't mean the child is unhappy, and that Madonna is the key to her happiness. I wonder if they would give the child to a normal person who was known for highly sexual behavior, having romping escapades with men, and who was never home. Why does she feel she is an exception to the law?

You do realize that other countries have their own rules, customs, and laws, right? Just because Madonna has a shitload of money, that doesn't mean she can get EVERYTHING that she wants. Also, they have laws against divorced people adopting…which she is. Add on the fact–whether true or not–about her boytoy, and the negative press revolving around that. But once again, she probably figured her money would do all of the talking…and this time it didn't work.

What's the advantage of being adopted by Madonna? I think having Madonna as a mother would only screw the kid up. It's not that we are talking about a normal nice little family the kid would be adopted into.
That's the risk with overseas adoption. Like adoption within the US, at any time they can say "no" and that's it.
Orphanages and foster homes are flooded with kids and it's still easier to pay a knocked up teen to skip the abortion clinic & hand their kid over to you. Even then, the birth mother can get a slimy lawyer to find a loophole & take the baby back.
Madonna should consider herself very lucky to have birthed 2 of her own and been given a chance to raise another. I deal with childless couples & singles that would sacrifice anything to have half the parental joy she has.

This little girl is an ORPHAN living in horrid conditions…and exposed to HIV, malaria and people all around her dying of AIDS and when someone who cares steps in to help her have a better life it's DENIED?! I am so happy! and so proud that the Malawi people respected the laws that are designed to protect their children, a child's happiness is based on how much real love and affection they get, not material wealth, and "IT" is uncapable of human emotions other than revenge and hate.
