You don't interfere with peoples' lives, trying to force them to get healthy! It's a personal decision, and if someone wants to go to town on a 128oz Dr. Pepper after a hard day's work ON THEIR CHEAT DAY, they should be allowed to in New York City!!
This is why INCENTIVES will always be better than a BAN! And the difference between this and smoking, for those of you with that in their mind, is that smoking hurts those around you as well — drinking a giant soda won't!
New York restaurants can continue selling large sugary drinks because an appeals court recognized that a lower court ruling was dead on! That ruling was that city's restrictions are "arbitrary and capricious," which is a very nice way of putting it!
Then they added that the city's Board of Health "failed to act within the bounds of its lawfully delegated authority" and things got a little bit frosty! Like an ice-cold 256oz Squirt! LOLz!
In essence, it was declared the regulation was a violation of the principle of separation of powers doctrine!
Mayor Michael Bloomberg, of course, disagreed with the decision because nobody in politics can EVER admit they're wrong! We're pretty sure they have to swear an oath to do so. Don't quote us on that though! Ha!
