JAY-Z Fighting Rape Accusation Through... Legal Loophole…

Well, this certainly doesn’t make him look more innocent…

JAY-Z is trying out a new strategy to fight his rape accusation. As we’ve been following, the rap mogul was accused by a mystery “Jane Doe” plaintiff of raping her with Diddy in 2000. Horrifyingly, she says she was just 13 years old at the time. JAY-Z has vehemently denied the accusation, and has even referred to it as a “blackmail attempt” while slamming her lawyer Tony Buzbee. But despite the Crazy in Love rapper’s attempts to have the case thrown out, it’s still moving forward — and the judge has been taking the alleged victim’s side so far, allowing her to remain anonymous!

So what now for Beyoncé’s husband? A legal loophole apparently.

In new court docs obtained by TMZ on Monday, JAY-Z’s lawyer Alex Spiro said he’s preparing to file a motion to have the suit dismissed because of… the timing. That is, the timing of the alleged rape and the statute of limitations that would protect Jane Doe in her bid to take legal action. According to Spiro, the statute the plaintiff is suing under didn’t take effect until December 2000, which was three months after she claimed to have been raped by JAY-Z and Diddy.

Spiro further argued that even if the statute did apply, the location Jane Doe described as where the alleged assault took place — a “large, white residence with a gated U-shaped driveway” about 20 minutes away from Radio City Music Hall — is outside of New York City, which is where the statute covers. He also claimed the plaintiff’s legal window expired in August of 2021.

WOW. So he went from denying it ever happened to pretty much saying, You can’t sue because of the time and place of the alleged rape?? Now don’t be mistaken, there’s been NO admission of guilt, but this just feels… Icky. We mean, do you really want to be the guy who got out of that rape case because of a legal loophole? That’s like the kind of guy Dexter would go after.

Buzbee feels strongly the law will remain on the alleged victim’s side. He told TMZ:

“These are technical arguments being made and the law is clearly on our side and the side of alleged victims. The law is well settled that we are correct.”
