The drama between Kristin Cavallari and Jay Cutler is already heating up!
As you’ve likely seen, The Hills alum shared on Sunday that she and her husband were in the process of getting a divorce. Since then, there’s been a TON of speculation regarding what went down to get them to this point, and according to Miz Cavallari, it has to do with “inappropriate marital conduct.”

In docs filed by the 33-year-old, which were obtained by TMZ, she said the former NFL player “is guilty of such inappropriate marital conduct as renders further cohabitation unsafe and improper,” and added “any misconduct alleged or implied against her in the complaint for divorce was in response to and/or as a result of misconduct on behalf of the Husband.”
According to some sources, infidelity has been ruled out as a reasoning for the split, but fans were definitely confused as to what this was all alluding to, and now we have some more info!!
For those unfamiliar, Tennessee is a “fault state,” AKA anyone asking for a divorce must have proof of fault on the part of the spouse, hence why she claimed Cutler is guilty of “marital misconduct.” This language is pretty standard for the state, meaning they can’t end the marriage without showing some misconduct, which has yet to be decided.
And apparently, the former couple’s dispute is largely over their three kids, as insiders close to the situation have now revealed to the outlet that the Very Cavallari star was “surprised” her husband filed first because she had no idea! Especially since he claims he was the “primary caretaker” and “at-home parent,” which Kristin says has been her role.
As it turns out, Jay is asking for joint custody of Camden Jack, Jaxon Wyatt, and Saylor James, while the former MTV star wants primary physical custody with her ex receiving visitation rights.
Sounds like there’s going to be a battle!
Unfortunately, their marriage has reportedly been unwinding for quite some time, and things even took a turn when Kristin’s BFF was at the center of affair allegations involving Jay, so this isn’t a huge surprise to those closest to the pair. Let’s just hope they’re able to civilly figure things out for the sake of their kiddos!!
