It’s official… Britney Spears is facing charges after her DUI arrest!

The Ventura County District Attorney’s Office announced on Thursday that the pop star has been charged with one count of misdemeanor DUI after she was pulled over and arrested on March 4. Whoa! So what comes next for Britney? Luckily for he, she may avoid jail time if she accepts the DA’s offer during her upcoming arraignment!

According to the office, prosecutors will likely offer her a “wet reckless” since she has no prior history of DUIs, had a low blood alcohol level, and did not crash or injure anyone while under the influence. Under the standard protocol, that basically means the person charged must plead guilty to reckless driving involving alcohol and/or drugs. They are then placed on probation for 12 months and receive credit for any time spent in custody. In addition, they must complete a DUI class and must pay any state-mandated fines and fees. Officials explained this resolution is “common,” especially when the defendant “demonstrates self-motivation to address underlying issues through rehabilitation or a drug and alcohol treatment program, which she has!

As we previously reported, Britney voluntarily checked herself into rehab earlier this month — not only to address her alleged substance abuse issues, which include struggles with alcohol and Adderall addiction, but in the hopes of easing the consequences of her actions. It looks like she got her wish. A source for People previously claimed her two sons, Sean Preston and Jayden James, also played a huge part in convincing the 44-year-old singer to enter treatment.

“Her sons were a big part of getting her to rehab. They’ve been clear with her. They just want her to be healthy. She was very upset and shaken after her arrest. And she’s terrified of going to jail. It’s taken weeks for her to realize that going to rehab is the best option.”

The DA’s officer said prosecutors will make the offer during her arraignment on Monday. It is unknown whether Britney will attend the hearing in person, but because she has only been charged with a misdemeanor, she is not required to and can have her attorney appear for her instead.
