JCPenney Wants $40 Million Lawsuit Thrown Out

Everything can’t be squared away!
JCPenney finally responded to Hudson + Broad $40 million lawsuit over that LED square used in their “Fair and Square” campaign.
On Wednesday the department store asked the court to not only vacate the certificate of default, but they also want the case to be thrown out completely.
But we all know that’s not gonna fly!
James Maharg, the president of H + B said they “will respond with the appropriate arguments to the court by July 13” and is giving JCPenney until July 27 to speak up, before the case goes in front of a judge.
Until then, the design firm is going public with their complaint and releasing YouTube videos addressing CEO Ron Johnson and spokeswoman Ellen DeGeneres to stand by their “fair and square” message.
We don’t know about you, but we think this is just shiesty! We really hope Hudson + Broad and JCPenney come to a $olution $oon!
