The Gossip Girl actress was seen bonding and grabbing lunch with her little ones on Friday — only one day after her MAJOR custody hearing overseas.
Unfortunately, a source relayed that though the feuding parents have joint custody, Miz Rutherford's mini-mes are to remain with their father in Europe for the time being.
However, the determined mother will have her chance again in Monaco's court system on October 26.

That's because after the Gossip Girl actress was forced to send her two children back to Monaco with their father Daniel Giersch, Kelly decided to take things to the South of France on Wednesday to duke it out in court.
But luckily, Kelly isn't alone — she brought along her lawyer as well as her GG co-star/on-screen mom Caroline Lagerfeld for emotional support!
We're glad Caroline is there to keep Kelly calm while she struggles to get Hermes, 8, and Helena, 6 back on United States soil.

Kelly Rutherford's Last Minute Attempt To Get Her Children Back Shut Down By Judge, But The Fight Is Far From Over!
This is just so sad.
However, the Gossip Girl star wasn't going to let her children go without a fight. Reportedly, the 46-year-old filed a federal lawsuit just an hour after the decision was announced in order to try to regain custody of her children from her ex-husband.
Unfortunately, a judge denied her suit the very same day.
Miz Rutherford's lawyer shared:
Kelly Rutherford is not going to take this fight lying down!
However, one of the biggest controversies was that the former soap actress initially refused to do so, making the German businessman accuse her of "child abduction."
Well now, the 46-year-old is addressing those claims.
On Friday, the Kentucky native appeared on Good Morning America where she talked — along with her lawyer Wendy Murphy — to Robin Roberts about her dilemma.
In regards to those kidnapping allegations, she said:
Kelly Rutherford REFUSES to be silenced!
As we reported on Tuesday, a NYC judge ordered the actress' children to be sent back to their father in Monaco immediately.
Well now, the Gossip Girl star released a statement vocalizing her distaste for the decision!
"What the judge did yesterday was shocking, illegal, and abusive to my children… Without any legal authority, a judge from the lowest ranking court in the state court system violated the highest ranking deferral constitutional rights of my American citizen children."
The thespian initially refused to hand over her two kids claiming she had no legal obligation to do so.
