Remember when Justin Timberlake “accidentally” exposed Janet Jackson‘s ta-ta during the 2004 Superbowl Half Time Show??
Well, a court today threw the decision to fine CBS half a million dollars for the incident!
The court of appeals basically said that the FCC ‘”arbitrarily and capriciously” departed from prior policy that exempted “fleeting” indecency from sanctions.’
In other words, in a bunch of different cases before that 2004 night, the FCC refused to fine people for little snippets of improper things, so why would they have changed that just to fine CBS?
The next step is to see if the FCC’s policy is even constitutional.
Should the have been fined, or is the FCC too sensitive??
