Kelly Rutherford is taking a stand!
As we reported on Monday, the Gossip Girl star was ordered by a judge to appear in a NYC court WITH her children to address her refusal to send them back to Monaco.
The thespian believes she is not legally required to perform such an action, while her ex Daniel Giersch vehemently disagrees.

Fast forward to Tuesday, the 46-year-old appeared in court…
BUT did not bring her kids!
One could only assume that this is an act of deviance from the former soap star and that she is again refusing to surrender over her brood.
While the German businessman did not arrive to the mediation, his grandmother did.
Yikes! This custody battle is heating up.
