Abercrombie & Fitch is asking a judge to dismiss The Situation‘s lawsuit against them because he has no right to do so.
In case you forgot, the Sitch is suing the preppy retailer for infringing on the GTL and the Situation trademarks. But according to A&F, Mike only applied for the trademarks, therefore he doesn’t own them.
Abercrombie also points out the “Gym, Tan, Laundry” application was suspended because MTV already owned “Gym, Tanning, Laundry” and the US Patent & Trademark Office thought they were too similar.
AND even without the trademarks, A&F claims their “Fitchuation” and “GTL” tees are still fair game because they are protected under a law that allows parody as part of free speech.
