Kelly Rutherford must be over the moon right about now!!
After a long and contentious custody battle over Rutherford’s two kids, Helena and Hermes, the actress FINALLY got some good news — the children will spend the summer in the United States!

Woot! We couldn’t be happier for this more than deserving momma!
When we first heard that the kids WOULDN’T be coming back earlier this month, we were very disappointed. It’s nice to know that the judge in Monaco, where the kiddos currently reside with their father, Daniel Giersch, did the right thing.
Kelly gushed:
“I am pleased with the outcome and that the children will be coming to the US for a part of their summer vacation. I am reassured by the Monaco process and the judge. Although I still maintain my legal objections about Monaco hearing the case, my serenity is restored.”
While the actress is understandably happy about the win, there’s still a long term fight to be had. Daniel is still making the claim that the kids MUST live with him since his United States visa was denied. Rutherford’s ex argues that he can’t uphold a joint custody agreement if the kids live with their momma in New York.
Ugh, such a mess!
The Gossip Girl‘s lawyer had harsher words for the courts, stating:
“The children are allowed to come to the U.S. because Monaco knows it has no authority to assert jurisdiction. So it’s not that Monaco ‘allowed’ the children to return to their own country, it’s that they had no choice ├óΓé¼ΓÇ£ because American citizens can never be forced to live in a foreign country ├óΓé¼ΓÇ£ period. Unless the kids are dual citizens ├óΓé¼ΓÇ£ and these kids are not.”
All good points!! With a legal shark and star power behind her, we have a feeling this case will ultimately sway in Kelly’s favor!
