This judge is NOT doing Halle Berry any favors!

Court officials dismissed her claims that Gabriel Aubry hit their daughter's nanny, ordered her to take parenting classes with her estranged baby daddy, AND NOW they're making berry pay HIS court fees!

According to our source:

"Halle has been ordered by the judge to pay Gabriel's legal fees. It's not uncommon in custody dispute cases when the parents aren't married. It's so that both sides will have a level playing field, and fees in custody disputes are racked up very quickly."

That is NOT how an A-lister is used to be treated! This must be ever so stressful for the actress.

Last week Berry was denied special treatment AGIAN when the judge refused to grant the restraining order to prevent Gabriel from seeing their daughter, Nahla, until the outcome of the criminal investigation she started over him "hitting" their nanny.

How long will the actress and her model baby daddy drag their poor 3-year-old through this?

The gimpy star was spotting with her daughter and her fiancé at lunch over the weekend.

Clearly, it takes more than a broken leg and a custody battle to bring this A-lister down! Despite all her the drama she's dealing with Halle and her fam giggled and snuggled the day away!

In the nasty custody battle between Halle Berry and Gabriel Aubry, officials from the Los Angeles Department of Children and Family Services are suggesting that the former couple take parenting classes - TOGETHER.

The two will be back in court today to find out if Halle's request to strip visitation rights of their three-year-old daughter Nahla from Aubry will be granted.

It all started Halle's nanny is claimed that she and Aubry got into an altercation over Nahla missing school. She says that he shoved her, WHILE Nahla was in her arms, which caused her to hit her head on a wall.

Last Friday, social workers interviewed both Aubry and Berry and are not only suggesting they take parenting classes together, but also that Nahla receives counseling.

An insider says:

"[The joint interviews] were to get these two in the same room and recognize that all of this fighting, is hurting their daughter. It was an emotionally charged interview as Gabriel feels that he can't do anything right, and there is reason to believe his concerns. Social workers have written an extensive report that will be given to the judge for his consideration, and that report will recommend that no changes in custody be made. The report recommends that Halle and Gabriel attend parenting classes together, so that they can co-parent Nahla together. The classes will give them the tools to work through their issues, and hopefully become better parents for it.

[The investigation] remains open while Gabriel and Halle take the parenting classes and to ensure that Nahla's safety and well-being continue. Gabriel absolutely wants to work with Halle, and that hasn't happened, so he is hopeful that can happen now.

Of course, Gabe doesn't like being accused of hurting his child or anyone, but he knows the truth and that he didn't do anything the nanny has accused him of. He wants to take this negative and turn it into a positive so that he can be the best father for Nahla."

At least he's willing to work it out. That's really all anyone can ask for.

If Halle and Gabriel just continue to have open and honest communication with each other than these problems should be a thing of the past.

What matters here is that he's making a step in the right direction!

After reports surfaced that Halle Berry's ex, Gabriel Aubry, pushed his daughter Nahla's nanny while the child was in her arms, the two were extensively interview for a few hours yesterday by representatives from the El Lay County Department of Children and Family Services, who have concluded that he, does, in fact, have anger issues that should be resolved in management courses!

Halle's former flame just got the heat turned up even higher on himself.

Gabriel Aubry was formally questions by Child and Family Services in El Lay County.

The model continues to deny pushing the nanny while she was holding Nahla and was describe as very nervous during the interview.

A source said the following about Aubry:

Gabriel feels that he is living in a police state as far as his time with his daughter is concerned.

He is a doting and loving father and extremely attentive to Nahla. His daughter wasn't present when the interview took place. The investigation will remain open at this point, but it's not uncommon at all for officials to keep an investigation open out of an abundance of caution to ensure the safety of the child.

Poor Nahla, this must be a disaster for her.

Halle and Gabriel go back to court on Monday after the judge presiding over their battle was on vaycay.

The latest in the Gabriel Aubry vs. The Nanny case is Aubry's side of the story.

As you know by now, Halle Berry's nanny is accusing Gabriel of calling her names and pushing her while she was holding his and Halle's three-year-old girl Nahla.

But sources close to Gabriel say that he didn't push the nanny. In fact, according to him, she tripped!

The insider adds:

"Why in the world would Gabriel push the nanny causing her to fall while she was holding his daughter? Gabriel is fiercely protective of Nahla. The nanny tripped, and she fell while holding Nahla. Yes, Gabriel and the nanny were arguing, he felt like his parenting skills were under attack again. Gabriel can't believe how out of control this situation has become. He is hopeful that criminal charges won't be filed against him."

Meanwhile, Halle and Gabriel are waiting on a judge's decision Next Monday to see if he has to stay away from his daughter.

So far, no charges have been made, but the Los Angeles Department of Children & Family Services is expected to interview both Halle and Gabriel, as well as the nanny in the next couple of days.

Oh boy. This is turning into such a mess.

As we told you earlier, Halle Berry's nanny is claiming that Gabriel Aubry yelled at her and called her names and alleges that he did this all in front of his and Halle's daughter, Nahla.

In the meantime, Halle visited a judge Tuesday morning, requesting that Gabriel stay away from Nahla until the child endangerment investigation is closed.

Unfortunately for Halle, the judge is having none of it after hearing both sides and wants to wait until NEXT Monday to make a decision. In fact, it looks like Judge Scott Gordon is pawning the case onto Judge Mark Juhas, who returns from vacay at the end of this week.

Both Halle and Gabriel were in court, but did not address the judge.

Holy hell. What are they putting this poor child through? This is insane!

Early today, Halle Berry's ex-nanny met took her restraining order against Gabriel Aubry to court -- and the judge shut it down.

The judge told the nanny, Alliance Kamdem, that her claims were "insufficient and speculative," which is practically saying "you're a liar" in judge-talk.

Kamdem, who already accused Halle's ex-husband hitting her, amped up her claim in court today. She said that on multiple occasions Aubry,

"would walk over and violently grab/take Nahla away from me."

The judge said Kamdem's issues should be resolved in family court.

Looks like this may have been a desperate attempt of Berry's to get the sole custody of Nahla she's been fighting for.
