Now that we’ve all recovered from the whiplash of Bijou Phillips shockingly filing for divorce from her husband Danny Masterson after being by his side throughout his rape trial, it’s time to dig into the divorce deets!
As we covered, the 43-year-old Almost Famous actress submitted her legal docs on Monday after nearly a decade of marriage. Some things are still up in the air, like their separation date which was just listed as “TBD.” But, naturally, she blamed “irreconcilable differences” as the cause for the split and is asking for full legal and physical custody of their 9-year-old Fianna, with visitation rights for her ex. TBH, that makes sense considering he’s going to be locked up!
Now, though, she is asking for spousal support from the convicted sex offender — and showing no mercy to him, she requested to have a judge “terminate the court’s ability to grant support” to the That ’70s Show alum, per People. Damn!

Also, it doesn’t appear as if they had a prenup in place before saying, “I do.” How do we know? She’s asking that their assets be divided by the court as separate property, and never mentions any kind of prenup agreement. Typically in Cali if you divorce without a prenup, the court will equally divide everything between both parties. It’s unclear exactly what assets they will be splitting up. This could either be very messy… or maybe the actor won’t put up much of a fight considering he’s headed to prison for 30 years to life anyway?
It’ll be interesting what becomes of this legal battle! We’re still trying to wrap our heads around why she filed in the first place considering she was supposedly ready and “eager” to keep the legal fight going with an appeal and had reportedly been visiting her hubby in jail “daily.” And now all of a sudden she’s divorcing his ass?! Why the sudden switch?? We’re dying to know!
