According to TMZ, in addition to lawsuits against Polaris' ATV's, the RZR 170 model the 8-year-old was driving had safety warnings stating kids under 10 should not be driving or even in the passenger's seat.
"Never allow a child under age 10 to operate or ride as a passenger in this vehicle. Children differ in skills, physical abilities and judgement. Please supervise the use of vehicle at all times. Permit continued use only if you determine that your child has the ability and maturity to operate safely."
Meanwhile, a Polaris spokesperson only had this to say about the accident:

As you know, on Sunday it was reported that Jamie Lynn Spears' daughter was in critical condition after an ATV accident on her family's property — right in front of Spears and her husband Jamie Watson.
According to the police report, the 25-year-old dove in and tried to rescue the girl, but was unable to free her from her safety belt and the ATV netting. Maddie is currently in critical but stable condition at a New Orleans hospital.

Last night, it was reported that Jamie Lynn Spears' daughter Maddie was in critical condition after an ATV accident on a hunting trip.
The 25-year-old later released a statement saying the media reports surrounding the accident were "incorrect," but did not clarify what actually happened to the 8-year-old.
Now, a newly released police report sheds more details on the harrowing incident, and it turns out Jamie Lynn saw the entire accident unfold right in front of her.
According to a statement by Tangipahoa Parish Sheriff Daniel Edwards, the crash did not take place on a hunting trip, but on the family property — right in front of Spears and her husband Jamie Watson.
Just before 3:00 p.m. on Sunday afternoon, Maddie was reportedly steering the ATV to avoid running over a nearby drainage ditch, and "overcorrected," causing the ATV to flip into a pond and submerge under the water.
The report explained that Jamie Lynn and her husband dove in and tried to rescue the girl, but were unable to free her from her safety belt and the ATV netting.
The dramatic report continued:
Being in critical but stable condition means her condition is not deteriorating but that she is still very ill.
Maddie got hurt after a Polaris off-road vehicle flipped over. She was reportedly submerged in a lake for several minutes and was unconscious when taken to a local hospital.
She was later airlifted to a hospital in New Orleans.

As we previously reported, Jamie Lynn Spears' daughter, Maddie, was hospitalized in Kentwood, Louisiana after a very serious ATV accident. It was being said the 8-year-old was airlifted to get treatment after being "under water for several minutes and unconscious."
The 25-year-old's dad, Jamie Spears, responded to news of the accident, telling Entertainment Tonight:
"All I can say is pray for our baby Maddie."
So far, the 8-year-old's condition remains unclear. It was reported it was "extremely serious," though the singer released her own statement on her daughter, saying:
In response to reports Sunday that her 8-year old daughter Maddie had suffered a serious ATV accident and was rushed to the hospital after being unconscious under water for several minutes, Jamie Lynn Spears just released the following statement:
"The details the media are reporting surrounding the incident regarding Jamie Lynn's daughter Maddie are incorrect. Right now the Spears family asks that everyone respect their privacy during this time and appreciates all the prayers and support for their family."
The family is deliberately not informing the public about Maddie's current condition. We continue to pray for her until they give us another update!
