Nicollette Sheridan‘s wrongful termination lawsuit against ABC for killing off her character on Desperate Housewives has resulted in a mistrial, since the jury was deadlocked in an 8-4 vote on the matter.
While ABC and Touchstone Television are asking El Lay Superior Court Judge Elizabeth Allen to grant a verdict in their favor, Sheridan’s lawyers are demanding a retrial. Since eight jury members voted in favor of the actress receiving punitive damages and they needed nine, her legal team thinks they can win a retrial and filed papers that state:
“The record establishes a conscious disregard for Sheridan and reveals that Cherry and Touchstone sought to penalize her and deprive her of significant income because she had the audacity to complain about being struck by her boss while at work.”
The network maintains that ├óΓé¼┼ôthe character had run its creative course” and a hearing on ABC’s motion to dismiss the case is set for April 13th.
